RELEASE AND WAIVER OF LIABILITY
The individual named below (referred to as “I" or “me”) desires to enter the property known as Olympus DCC, located in Brooksville, Florida (the “Property”), for the purpose of playing disc golf (the “Activity”). In consideration of being permitted to enter the Property and participate in the Activity, I agree to the following terms and conditions:
I AM AWARE AND UNDERSTAND THAT ACCESSING THE PROPERTY AND PARTICIPATING IN THE ACTIVITY MAY INVOLVE THE RISK OF SERIOUS INJURY, DISABILITY, DEATH, AND/OR PROPERTY DAMAGE. I ACKNOWLEDGE THAT ANY INJURIES I SUSTAIN MAY RESULT FROM OR BE COMPOUNDED BY THE ACTIONS, OMISSIONS, OR NEGLIGENCE OF OTHER USERS.
NOTWITHSTANDING THESE RISKS, I ACKNOWLEDGE THAT I AM VOLUNTARILY ACCESSING THE PROPERTY AND PARTICIPATING IN THE ACTIVITY WITH FULL KNOWLEDGE OF THE DANGERS INVOLVED. I HEREBY AGREE TO ACCEPT AND ASSUME ANY AND ALL RISKS OF INJURY, DISABILITY, DEATH, AND/OR PROPERTY DAMAGE ARISING THEREFROM.
2. I hereby expressly waive and release any and all claims, now or hereafter known, against the property owner, McCease, LLC, and its officers, directors, managers, employees, agents, affiliates, successors, and assigns. I covenant not to make or bring any claim against the property owner or any other Releasee, and I forever release and discharge the Owner and all other Releasees from liability under such claims.
3. I agree to follow all instructions from management, employees, or volunteers and obey all posted signs.
4. This Release constitutes the sole and entire agreement between the property owner and me with respect to the subject matter contained herein and supersedes all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral. If any term or provision of this Release is found to be invalid, illegal, or unenforceable in any jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other term or provision of this Release. This Release is binding upon and shall inure to the benefit of the Owner and me, as well as our respective successors, assigns, heirs, executors, and personal representatives.
All matters arising out of or relating to this Release shall be governed by and construed in accordance with the internal laws of the State of Florida, without regard to any choice or conflict of law provisions. Any claim or cause of action arising under this Release may be brought only in the state courts located in Hernando, Florida, and I hereby consent to the exclusive jurisdiction of such courts.
BY SIGNING, I ACKNOWLEDGE THAT I HAVE READ AND UNDERSTOOD ALL OF THE TERMS OF THIS RELEASE AND THAT I AM VOLUNTARILY GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE THE OWNER.
